Introduction
These conditions of sale (hereinafter only "Terms") govern the sale of products marketed by www.verbax.it. All contracts to purchase products through the site www.verbax.it and according to procedures described above, between the seller and the customer will be governed by these Terms.
Acceptance of sale conditions
The contract between Verbax Srl and the Customer shall be concluded with the acceptance, even partial, by Verbax Srl. By placing an order in the manner provided, you acknowledge that you have read all the directions during the purchase procedure and accept the general conditions and payment below.
If the customer is a consumer (ie a person who buys goods for purposes not related to his profession), once the online purchase procedure, will print or save an electronic copy, but keep the present general conditions of sale, subject to the requirements of Art. 3 and 4 of Legislative Decree no. 185/1999 on distance selling.
It excludes any right of the Customer to damages or compensation, and any contract or tort liability for any direct or indirect personal and / or property, caused by the rejection, even partial, of an order.
How to Buy
The customer can only purchase products in the electronic catalog of Verbax Srl at the time of the order and viewable at www.verbax.it, as described in the relevant information sheets. The technical information included in the site www.verbax.it faithfully reproduces those of the manufacturers of the products included in the catalog. Verbax Srl, therefore, reserves the right to change the technical information of products to match those provided by the manufacturers without any notice.
The correct order is confirmed by Verbax Srl through an e-mail, sent to the email address supplied by the customer. This confirmation message will contain the date and time of receipt of the order and a 'Customer Order Number', to be used in any further communication with Verbax Srl. The message will include all data entered by the customer who agrees to verify the correctness and communicate any corrections, as described in this document. Customer can also check the status of your order by going to the website dedicated to him.
In the case of non-acceptance, Verbax Ltd is committed to a timely notification to the customer.

Payment methods
Wire Transfer Policy

Credit Card
For payments by credit card using the Paypal system. Together with the completion of the online transaction, the bank reference shall authorize only the amount of your purchase. The amount for the goods processed will be charged to the credit card of the customer at the time of the actual fulfillment of the goods ordered. The credit cards accepted are those managed by Paypal.
In case of cancellation by both the customer and in case of rejection of Verbax Srl, the same time require the cancellation of the transaction and release the amount involved. The annulment of the transaction, in no event Verbax Srl be liable for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.
At no time during the purchase process Verbax Srl is able to know information about the buyer's credit card, as they are typed directly on the site of the bank handling the transaction (with very high security systems); since there is no transmission data, there is the possibility that this data is intercepted. Transaction Security
The online transactions by credit card are made directly on the Bank's website, through a secure server adopting the security system SSL (Secure Socket Layer). This protocol, certificate, may communicate in a way designed to prevent the interception, alteration or falsification of information. Verbax Srl is not aware of the data of credit cards used by your customers.
Delivery methods
For every order placed on www.verbax.it, Verbax Srl issues an invoice for the sent goods. For the issuance of the invoice, to the information provided by the Customer. No change in the bill will be possible after the issuance thereof.
Shipping costs are charged to the customer and are shown explicitly at the time of order. The payment of the goods by the customer will be using the method chosen when ordering. No fees or commission is due to Verbax Srl.
Delivery times vary depending on the mode of payment and the ordered product. The booking of goods based on availability is immediate. The average time of order fulfillment (parcel delivery by us to the carrier) can vary from 2 to 5 working days. At the time of delivery of the order must be added the time of the courier that is 24 hours for most of the Italian territory and 48 hours for the islands and some areas particularly difficult to reach.
No responsibility can be attributed to Verbax in case of delay in the order or delivery of goods ordered.
Upon delivery of the goods by the courier, the customer is required to check that the number of boxes is the same as indicated on the invoice and that the packaging is not damaged or wet or otherwise altered;
Any external damage or the mismatch in the number of packages or particulars, must be immediately reported to the carrier making the delivery, adding the word "withdrawal conditional" on the appropriate document and confirmed within 8 days by registered mail return to the courier whose address is explained on the accompanying document. In case of damaged package, write "subject to removal" because the package is damaged. Once signed the slip, the customer can not make any objection about the appearance of the goods. Despite the packaging intact, the goods must be verified within eight days of receipt. Any damages or hidden defects must be reported in writing by registered mail with return receipt to the courier whose address is explained on the accompanying document.
Right of withdrawal
Under Article. 64 et seq of Legislative Decree. N. 206/2005, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does the purchase by indicating in the order form to Verbax Srl a reference to VAT) He has the right to rescind the purchase contract for any reason without penalty and except as described in paragraph 3.
To exercise this right, the customer must enter a request for withdrawal on-line in the "Order Status" or send mail in which you must also give the bank needed to repay the sums paid; the system will send the customer an email with a paper form to be printed and sent by registered letter with acknowledgment of receipt within 10 working days of receipt of the goods:

Upon receiving the letter, Verbax Srl send email to the customer in the form of exercising the right of withdrawal provided with an authorization number that must be attached to the outside of the enclosure in which the product will be physically located and sent to Verbax Srl within 10 days.
The right of withdrawal is subject to the following mandatory conditions:
The law applies to product purchased in its entirety; it can be exercised only on the withdrawal of the product (ex .: accessories, software, attachments, etc. ...);
The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc ...); It should be avoided in all cases the attachment of labels or tape directly on the packaging of the product;
the property subject to the right of withdrawal must be returned in normal condition, as it has been kept and used with the use of reasonable diligence: not will then be accepted products used that indicate signs of damage or dirt and that therefore they can no longer be considered;
the property subject to the right of withdrawal must bear the same serial number on the invoice selling Verbax Srl; if the goods were to return a serial number other than that indicated on the invoice, the return will not be accepted and the product will be made available to the customer for his return, while canceling the request for withdrawal;
shipping charges for return of the asset are charged to the customer;
the shipment until the certificate of receipt in our warehouse is under the responsibility of the customer;
if the goods are damaged during transport, Verbax Srl will inform the customer (within 5 working days of receipt of goods in their stores), to enable him to file a timely complaint against the carrier of his choice and to obtain reimbursement the value of the asset (if insured); in this case, the product will be made available to the customer for his return, while canceling the request for withdrawal; Verbax Srl is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
Verbax Srl will refund the customer the full amount paid (except shipping and handling), as quickly as possible and within 30 days of receipt of the cancellation notice, after receipt of the goods covered by the withdrawal, by transfer of the amount charged on the credit card or by bank transfer. In the latter case, the Buyer shall promptly provide to the bank on which the reimbursement (Cod. ABI - CAB - Current Account of the invoice).
In any case, Verbax Srl will pay the shipping costs if the reason for the return was a product defect or an error in the order due to Verbax Srl.
The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), where Verbax Srl finds:
the lack of external and / or internal packaging;
the lack of product components or defect to the product itself;
the product is damaged for causes other than its transport;
a state of filth of the product due to its use, which has compromised its integrity.
The costs and risks of transport for the return shall be borne by the customer. The return of products that are damaged, deteriorated or lacking in accessories and original equipment will not be accepted by Verbax Srl and will be returned to the sender with the burden of transport costs. In case of forfeiture of the right of withdrawal, Verbax Srl will return to sender the property purchased by charging the same shipping costs.
Warranty
Under Decree 24/02 paragraph 4.3.1 the warranty period of:
- 24 months for individuals (purchase turnover tax code);
- 12 months for legal entities or professionals (purchasing turnover with VAT).

4.3.1. Protected party
Who is covered by the new regulations is the consumer, ie a natural person who, in contracts for the sale of consumer goods and other equivalent, is acting for purposes unrelated to business or professional activity;
They are not "consumers":
- Legal persons;
- Entities other than individuals with non-profit organizations (associations, foundations, committees);
- Individuals classified as "professionals";
For warranty, the customer can present to the service center of their city with the purchase invoice.
For products that do not have a national service network guarantee will be managed directly by Verbax srl: the costs and responsibility of shipments of return and delivery will be charged to the customer. The dispatch of the goods at our office must be authorized by our customer service. To request permission to return the customer must send an email to verbax@verbax.it. Customer service will issue a RMA number required for acceptance of the goods.
WARNING: Verbax S.r.l. is authorized to collect goods on whose packaging has not reported the number of RMA.
Articles declared defective control will be working will be returned with shipping costs paid by the recipient with an additional penalty of €. 50.00 + VAT for the right to intervene.
Assistance in returning the goods are accepted under the conditions described above.
Privacy
The personal information requested under the order are collected and processed by Verbax Srl on media, in order to meet the obligations under the contract with the customer and will not under any circumstances and no license to third parties. WEEE INFORMATION
What is WEEE
WEEE is Waste from Electrical and Electronic Equipment (EEE), i.e. waste from appliances that depend for their operation on electric currents or electromagnetic fields with an operating voltage not exceeding 1000 volts in alternating current and 1500 volts in direct current .
How WEEE should be managed
The WEEE Decree (Legislative Decree 49/2014 "Implementation of Directive 2012/19/EU) requires that all WEEE must follow a differentiated collection procedure, favoring the recovery and recycling of the materials of which they are made.
Violation of legal obligations, even by private citizens, is punished with administrative and penal sanctions.
Incorrect disposal of WEEE can cause serious damage to the environment and to the health of living beings due to the dangerous substances that may be contained in the equipment, components and batteries.
The symbol indicating the separate collection of electrical and electronic equipment and batteries is a crossed out wheeled bin, (with a horizontal bar at the bottom which identifies electrical and electronic equipment placed on the market after August 13, 2005). This symbol is shown on electrical and electronic equipment or, where this is not possible due to the size or function of the product, on the packaging and on the instructions for use.
The domestic consumer can deliver old electrical and electronic equipment to the retailer, to the public collection service, or deliver them to the appropriate municipal ecological center indicated by the WEEE Coordination Center on the website www.cdcraee.it.
Verbax s.r.l. contributes to the financing of the collection and treatment of EEE electrical and electronic equipment and end-of-life batteries. The cost of disposal is included in the sale price when the item is an EEE and not a component to be incorporated into an AEE.

"ONE AGAINST ONE" at the time of purchase
In compliance with the provisions of art. 1 of Ministerial Decree 65/2010 and by art. 11 of Legislative Decree 49/2014, at the time of the supply of new electrical or electronic equipment intended for a household, Verbax srl ensures the free collection of the old EEE ("one-against-one" collection) having the same functionality.
How to request the free collection of WEEE
Once the purchase process in the Verbax e-store has been completed, to request the free collection of EEE waste, simply call or send an email to verbax@verbax.it with the subject "WEEE collection" indicating the reference of the order. In case of purchase of several products, it will be necessary to specify in the message the quantity of products for which you wish to use the one-on-one WEEE collection service.
How the free collection of WEEE takes place
The user requesting the WEEE service will be contacted by the courier appointed by Verbax s.r.l to arrange the collection date, which will take place within 30 days of receipt of the request. On the agreed date, the user will have to find the used product ready for collection, packed and withdrawable from the place where it is located. It should be noted that the collection address of the equipment to be collected must coincide with the delivery address of the new equipment purchased.
The free collection of WEEE takes place on condition that it is of an equivalent type and has performed the same functions as the new purchased equipment intended for a household. .
Pursuant to art. 12, paragraph 4, Legislative Decree 49/2014, the collection of WEEE can be refused:
- in the event that there is a risk of contamination of the personnel in charge of the collection;
- in the event that the WEEE are deprived of their essential components;
- in the event that the equipment for which collection has been requested contains waste other than WEEE;
If the product for which the customer requests the WEEE Service contains personal data stored within it, it is necessary for the owner to proceed with the cancellation of the same to comply with the privacy requirements.
Complaints
Any complaint must be addressed to Verbax Srl, Piazza delle Istituzioni 39F - 31100 Treviso (Italy).
Jurisdiction and Applicable Law
The sales contract between the customer and Verbax Srl are regulated by Italian law. For the solution of civil and criminal litigation, jurisdiction is the forum of Treviso.
